What is involved in submitting a development application to Council and obtaining approval for my development?

Broadly there are four stages in the development application process through Council.  

Pre-lodgement advice: Prior to finalising your development plans it is a good idea to meet with Council to discuss your proposed development. This may be a formal meeting with Council or simply a discussion with the Duty Planner. This provides you, the applicant, with a good opportunity to discuss Council’s needs and to identify if there might be any limitations or constraints for developing on your site. At this point Council might be able to indicate to you what additional reports you may need to submit with your application.

Submitting development application: The applicant will be required to submit a development application. Accompanying this application is often architectural plans of the development, a Statement of Environment Effects or Review of Environmental Factors, depending on the size of the proposal and its potential environmental impacts, and possibly a range of other environmental reports including on-site wastewater report, flora and fauna assessment, bushfire assessment, contamination report, water management report, salinity report.

Development application assessment: Council assess the proposal following a site inspection and assessment of the Statement of Environmental Effects or Review of Environmental Factors as well as any environmental report. It is possible that Council may request for additional environmental reports to be prepared or further information provided to environmental reports already submitted.

Development approval: Council issues the applicant with a development approval with a set of conditions that must be adhered to.

What is the difference between a Statement of Environmental Effects (SEE) and Review of Environmental Factors (REF)?

A SEE is a small document that outlines the proposal and gives an overview of the potential environmental impacts and the proposed mitigation measures that will be implemented to minimise the potential environmental impacts. A SEE is usually prepared when the environmental impacts are considered to be minor. A REF is a larger document and needs to be prepared in accordance with the Environmental Planning and Assessment Act. As in the SEE, the REF gives an overview of the proposal, however as the environmental impacts as a result of the proposal are expected to be larger, all environmental issues need to be considered. It is a more comprehensive document outlining the potential environmental impacts as well as the proposed mitigation measures to minimise these impacts.
